In consideration of the mutual covenants contained herein,聽TRINITY COLLEGE (the 鈥淐ollege鈥) and the undersigned (the 鈥淩esident鈥) agree as follows:
1. Occupancy Conditions
a. The College grants to the Resident a license to use and occupy a room (the 鈥淩oom鈥) in the Residences located at 6 Hoskin Avenue, 44 Devonshire Place, or 25 Devonshire Place, and respectively known as 91直播 Residence, St. Hilda鈥檚 College Residence and Lawson Centre for Sustainability Residence (the 鈥淩esidences鈥) for a period (the 鈥淥ccupancy Period鈥) commencing on the official move-in date (Sunday, August 30, 2026 for newly admitted first-year students registered for and attending Orientation and Monday, September 7, 2026 for returning students) and ending forty-eight (48) hours after the Resident鈥檚 final spring examination/assessment or聽at 12:00 (noon) on Friday, April 30, 2027 whichever is the earlier date (the 鈥淰acating Date鈥), unless terminated earlier pursuant to the provisions of this Agreement.
b. Residents may request to stay in residence beyond 48 hours after their final exam; however, approval is subject to availability and circumstances. Additional charges may apply.
c. The Residences are closed for the December/January Winter Break. All residents are expected to vacate their room no later than 48 hours after their final fall exam or by 12:00 (noon) on Wednesday, December 23, 2026, whichever date is earlier. The residences will reopen on Thursday, January 7, 2027, at 8:00 am, EST. During the closure period, the residences will not be open and as such, students will not be permitted to stay in residence for any reason. Staff in the Office of the Dean of 91直播 are available to advise students about alternative housing options for the winter break, however, the responsibility for all aspects of deciding upon, securing and payment for accommodations during this time are the responsibility of the individual student.
d. If a Newly Admitted Student Resident, defined as a student who did not attend 91直播 the previous year, does not take possession of, and occupy, the Room by 11:59 pm Sunday, August 30, 2026, the Room license is automatically forfeited and cancelled and the student will be liable for both residence deposits #1 ($1000) and #2 ($1000). The College may then license the Room to another resident forthwith, without notice to the Resident.
e. If a Returning Student Resident, defined as a student who was admitted to and attended 91直播 in any year prior to the current year, does not take possession of, and occupy, the Room by 11:59 pm Monday, September 7, 2026, the Room license is automatically forfeited and cancelled and the student will be liable for both residence deposits #1 ($1000) and #2 ($1000). The College may then license the Room to another resident forthwith, without notice to the Resident.
f. If after accepting an offer of residence a student (newly admitted or returning) decides that they no longer wish to live in residence they are encouraged to notify us immediately. Please refer to section 10.b. for more information regarding penalties for early residence withdrawal.
2. Eligibility
Only full-time University of Toronto students who are enrolled in a minimum of 3.0 FCEs, with a minimum of 3 courses in each of the Fall and Winter semesters, or comparable course load in a professional faculty or Faculty of Divinity, in good academic standing (minimum annual grade point average of 1.50+) and demonstrate progression in their academic program are eligible to reside in 91直播 Residences unless alternate arrangements have been approved in writing by the Dean. Residents who withdraw from the University or drop below full-time status in either the Fall or Winter semesters, are required to inform the Office of the Dean of 91直播 immediately. The College reserves the right to check the academic status of students to confirm their eligibility for residence as required.
3. Room Assignment
The Room and room type shall be assigned to the Resident by the Dean of 91直播 (the 鈥淒ean鈥), or the Dean鈥檚 designate.
91直播 reserves the right, without prior notice and at any point during the Contract term, to alter roommate assignments, accommodation placements, and/or consolidate vacancies, potentially necessitating a relocation from one accommodation to another. This may include moving a residence student to a different area, floor, building, or room. Furthermore, the College, at its absolute discretion, reserves the right to provide the option of converting double occupancy rooms into single rooms, adjusting maximum occupancy limits. In either scenario, a rate change, determined by the College, may be applicable.
4. Residence Fees
The Resident will pay an occupancy fee for the assigned room type and the meal plan. All residents are required to purchase a meal plan as outlined on the聽91直播 Residence Fees webpage. The website also represents the portions due on the stated dates. The amount due will be the stated amounts minus any credits that may have already been applied. Any balance due must be received in full by the College or University by the dates stated in order to avoid the accrual of service charges on outstanding fees.
Please note that if Deposit #2 is not received by the deadline聽communicated to students, it will be recognized as a forfeiture of the Residence Room and of Deposit #1, and the Room will be reallocated to the next eligible student on the waiting list.
5. College Environment
It is understood by the Resident that the residence facilities of the College are intended to promote a harassment-free environment and to enhance the academic and intellectual development of its students, their personal growth and their involvement in campus life and that, accordingly, the atmosphere, environment and behaviour in the Residences shall be conducive to, and consistent with, the achievement of these purposes.
To foster safe and welcoming residence communities, all students living in residence are expected to complete a mandatory online sexual violence education and prevention training module (the 鈥淢odule鈥).
a. Completion before move-in: As a condition of living in residence, students are expected to complete the Module prior to moving into the Residence.
b. If the Resident is unable to complete the Module prior to move-in, the Resident will be permitted to move into the Residence on the condition that the Resident completes the Module within 14 days of their move-in date.
c. Termination:聽The University reserves the right to terminate the Occupancy Agreement if the Resident does not comply with this requirement and upon exercising this right, the Resident will be required to vacate the Residence.
Additional information: Questions or concerns about the Module may be directed to the Office of the Dean of 91直播 (trinity.deanofstudents@utoronto.ca). The University may consider requests for an exemption to the requirement, in its sole discretion, provided that the request is made by the Resident to trinity.deanofstudents@utoronto.ca. Exemption requests should be made as soon as practicable for the Resident but no later than 3 days prior to move-in date in order to provide the University with sufficient opportunity to review the request and to discuss with the Resident, if necessary
6. Responsibilities of the College
The College will:
a. provide the Resident with the furnishings listed in Schedule 鈥淎鈥澛until the Vacating Date; and
b. maintain the Room and the Residences in a reasonable state of repair and fit for habitation
7. Responsibilities of the Resident
a. The Resident will:
i. comply fully with the 91直播 Community Standards, the聽, the聽, the聽91直播 Dining Hall Policy, the聽91直播 Alcohol Policy, the聽, the聽(PDF), the聽91直播 Residence Admission Policy, and the聽91直播 Episkopon Policy.
ii. receive either a fob or one key for the Room and one key for admission to the assigned Residence building and one mailbox key (herein referred to as 鈥渒eys鈥). The keys shall be returned by the Resident to the College on or before the Vacating Date. The Resident will not lend, nor duplicate, nor permit duplication of, nor be in possession of a duplicate of, any of the keys. If the Resident loses their keys, or fails to return them on the Vacating Date, the cost of replacing the keys will be billed to the Resident.
iii. maintain the Room in a clean and hygienic condition and will not allow any refuse, garbage or other objectionable material to accumulate in or about the Room or the Residences;
iv. comply with the 91直播 Residence Network (ResNet) Rules and Policy.
b. The Resident will not:
i. assign this agreement or sub-license (e.g. Airbnb) the Room or any part thereof to any other person or otherwise part with the possession or occupation of the Room;
ii. paint or decorate the Room or Room Door or any wall, ceiling or surface of the Residences without the consent of the Dean;
iii. deface any wall, ceiling or surface of the Residences, including the windows, or damage the Residences or its furnishings or permit their guests or invitees to do so;
iv. under any circumstances tamper with or change the lock, or add a lock, locks or other security devices to the door of the Room;
v. make any alterations to the structure of the Room or affix anything to the walls or ceiling thereof without the prior consent of the Dean;
vi. bring any external furniture into the Room, or remove original furniture from the Room;
vii. keep any devices in the Room that are not Ontario Electrical Safety Code approved. Such items can be removed from any Room as a potential fire hazard;
viii. keep or use a waterbed, open element (such as a hot plate, toaster etc.) or heating equipment (such as a space heater) in the Room, or use any device that might overload the electrical circuits (more information is available on the Frequently Asked Questions聽page of our website) ;
ix. tamper with or in any way interfere with the operation of any fire detecting or smoke detecting equipment for any reason;
x. store, prepare, or consume 鈥渟elf-heating instant hot pot鈥 meals in the Residences;
xi. keep any firearms, ammunition, air guns/rifles, fireworks, prohibited weapons, offensive weapons, replica weapons, slingshots, explosives, illicit narcotics and drugs, animals, reptiles, birds, fish or insect in the Room or in the Residences.
xii. engage in any behavior that disrupts the College鈥檚 ability to effectively allocate resources and manage residence operations.
xiii. behave in a manner that will unreasonably disturb, annoy or interfere with, the use or enjoyment of the Residences by the other residents, or permit anything to be done or kept in the Residences which will obstruct or interfere with the enjoyment or rights of the other residents; or
xiv. commit or permit an illegal act to be committed in the Residences.
8. Entry by College Staff
Authorized Residence Staff may enter the Room without notice in the event of an emergency or where there are reasonable grounds to believe there is an imminent risk to health, safety, or property.
For non-emergency purposes, including inspection of sanitation, safety, maintenance, or repair, the College will provide reasonable advance notice where practicable and will enter at reasonable times.
Entry will be conducted in a manner respectful of the Student Resident鈥檚 privacy and dignity.
9. Termination by the College
a. The College may at its option terminate this license upon the happening of any of the following events:
i. non-payment by the Resident of any amount due to the College or University;
ii. breach by the Resident of any other provision of this agreement or the Rules and Regulations as published from time to time; or
iii. any event whereby the Resident ceases to be a registered student with a full-time enrollment status聽at the University of Toronto, including but not limited to the suspension or expulsion of the Resident from studies during the academic session.
iv. in accordance with section 17.
b. In the event that the College exercises its option to terminate this license, the College or its designated official shall give written notice of such termination to the Resident, which shall specify the effective date of the termination, which shall not be less than three (3) days following the giving of the notice (the 鈥淓ffective Date of Termination鈥). The notice may be hand delivered to the Room or affixed to the door of the Room, addressed to the Resident.
c. Notwithstanding paragraph (b), under exceptional circumstances, including the occurrence of an 鈥淓mergency鈥 as defined in Section 17, the College reserves the right, to be exercised by the Dean acting reasonably, to give written notice of termination of this license not less than 24 hours before the Effective Date of Termination.
d. Notwithstanding the early termination of this license, the Resident shall at the option of the College be liable for payment of the full amount of the occupancy fee, whether or not the room is re-occupied or the Residences are filled.
10. Termination by the Resident or Early Withdrawal
Residents are admitted to 91直播 Residences on the understanding that they will occupy their assigned space for the full Occupancy Period, defined as the Fall and Winter academic terms. This section outlines the policies governing residence application cancellation prior to occupancy, early withdrawal after occupancy has begun, notice requirements, billing, and applicable withdrawal fees.
a. Application Cancellation Prior to Occupancy
91直播 who cancel their residence application prior to taking occupancy are subject to the following cancellation penalties:
Failure to take possession of a residence space by the designated move-in deadline without approved arrangements will be treated as a cancellation and subject to the above penalties.
b. Withdrawal After Occupancy Has Begun
Once a resident has taken occupancy, any decision to withdraw from residence constitutes an early withdrawal and is governed by the Move-Out & Billing framework below. Residents must submit a written Notice of Residence Withdrawal in advance of their intended move-out date.
Residents remain financially responsible in accordance with the timelines and fees outlined in subsections c through f, regardless of the reason for withdrawal, unless an approved exception applies under subsection i.
c. Designated Move-Out Dates 鈥淓xit Windows鈥
91直播 Residences observe two official move-out dates per month:
鈥 The 15th of the month
鈥 The final day of the month
All residence contract terminations must align with one of these designated dates. Daily or hourly prorating of residence fees is not offered.
d. Notice Requirements
Residents must provide a minimum of 30 days鈥 written notice prior to their intended move-out date. The selected move-out date must correspond to one of the designated exit windows.
Once a notice has been accepted, the approved move-out date is final and irrevocable, except where an approved exception applies. The 鈥渘otice date鈥 is defined as the date on which written notice is received by Residence Operations.
e. Early Withdrawal Fees and Billing Structure
In addition to being responsible for residence fees through the approved move-out date, residents who withdraw after occupancy are subject to the following early withdrawal fees, based on the timing of their approved move-out date:
i. Move-out occurring between the occupancy start date and September 30: $2,000 early withdrawal fee, plus residence and meal plan fees through the approved move-out date
ii. Move-out occurring between October 1 and November 30: responsible for $2,500 early withdrawal fee, plus residence and meal plan fees through the approved move-out date
iii. Move-out occurring after November 30: responsible for full residence and meal plan fees for the full Occupancy Period (Fall and Winter semesters)
f. Physical Departure vs. Contract End
Residents may physically vacate their room prior to the approved move-out date; however, early physical departure does not reduce financial responsibility.
Residence fee charges apply through the official move-out date, regardless of whether the resident physically vacates the room earlier.
Billing concludes on the designated move-out date once all keys and or fobs are returned and the room is fully vacated. Refunds, where applicable, are processed only after room inspection and account reconciliation.
Once keys or fobs are returned, residents may no longer access the room or re-enter the space. Residents who vacate without completing a formal check-out and returning keys or fobs will continue to be billed until proper procedures are completed.
g. Room Inspection, Damages, and Belongings
Room inspections are conducted following the official move-out date. Damage assessments are usually completed within ten business days, and any applicable charges will be itemized and communicated in writing.
Residents may appeal damage charges through the established residence appeals process.
All personal belongings must be removed by the official move-out date. 91直播 Residences do not provide post-move-out storage. Items left behind will be managed in accordance with the Abandoned Property process.
h. Withdrawal from the University
Residents who withdraw from the University or cease to hold full-time academic status must vacate their residence space within 48 hours, unless alternate arrangements are approved in writing by the Dean of 91直播 or their designate. Financial responsibility and early withdrawal fees will be assessed in accordance with section e – “Early Withdrawal Fees and Billing Structure”.
i. Exceptions Limited and Documented
Exceptions to these policies may be considered only under limited circumstances, including academic program end dates, visa or immigration requirements, medical or accessibility-related needs, University-initiated relocations, and safety or emergency situations.
All exceptions require documentation, must align with the nearest feasible designated move-out date, are approved by the Dean of 91直播 or designate, and do not guarantee a waiver of early withdrawal fees.
j. General Provisions
All residents, including those withdrawing for academic or personal reasons, remain subject to the withdrawal fees and billing structure outlined above.
Residence and meal plan fees and contract terms will not be adjusted in the event of changes to the University of Toronto鈥檚 mode of course delivery. Mandatory quarantine or similar external requirements do not alter residence contract dates or fee responsibilities unless explicitly approved.
11. Residential Tenancy Act Exempt
The parties acknowledge that this Agreement constitutes a license to occupy student residence operated by an educational institution and is not a residential tenancy agreement. As such, certain provisions of the Ontario Residential Tenancies Act, 2006 do not apply. Residents are encouraged to review applicable legislation for further information
12. Pest Outbreaks
Residential buildings are occasionally subject to pest outbreaks, including but not limited to, bedbugs. If a pest outbreak is suspected, residents are required to immediately contact the Welcome Desk or the Office of the Dean of 91直播, so an inspection can be arranged. If the presence of pests is confirmed, residents will be required to actively participate in the treatment by following the directives of the College and/or professional Pest Control workers. To reduce the likelihood of spreading pests to unaffected areas, residents will not be relocated to a new room. No refund or reduction of fees will be issued to those who are inconvenienced by pest inspection or remediation processes.
13. Construction and Renovation聽
91直播 may, from time to time, undertake construction, renovation, maintenance, or repair work within or near residence buildings. While the College will make reasonable efforts to minimize disruption to residents, such activities may result in noise, dust, restricted access, or temporary interruptions to services. The College shall not be liable for any inconvenience, discomfort, or disruption arising from such work, and no reduction in residence fees, compensation, or other remediation will be provided for any direct or indirect impacts experienced during the period of occupancy.
14. Liability
The College shall not be liable to the Resident for any damage to, loss, or theft of personal property or for personal injury, including death, on the Residences property save where the same is caused by the willful or negligent act or omission of the College or those for whom the College is in law responsible. The Resident will indemnify the College and save it harmless from any and all liability in respect of any injury, loss or damage occasioned by any act or omission of the Resident, their guests, agents or invitees.
15. Insurance
The Resident is required to have adequate insurance to cover any deliberate or accidental damage that they might cause to the Residences or other residents belongings. The College reserves the right to seek restitution for any damages caused by the Resident.
16. Lawson Centre for Sustainability Timber Wall Care
The Lawson Centre for Sustainability Residence features exposed timber walls as a core architectural and sustainability element. These surfaces require specialized care and cannot be repaired in the same manner as standard drywall. Residents must not affix anything to the timber walls, including but not limited to the use of nails, screws, tacks, adhesive hooks, mounting strips, tape, putty, decals, or adhesives of any kind, nor lean heavy furniture, bicycles, or equipment against them. Any damage to timber walls identified during occupancy or at move-out will be assessed based on the actual cost of repair or restoration, not standardized fees, and residents shall be responsible for all associated costs, which may be substantial due to the specialized materials and restoration methods required.
17. No Reduction of Fees
Temporary interruption or curtailment of accommodation, facilities, or services may occur due to maintenance, repairs, construction, or circumstances beyond the College鈥檚 control. The College will make reasonable efforts to minimize disruption. Fee reductions will not normally be provided for short-term or minor interruptions. Where a substantial portion of residence services cannot be provided for an extended period, the College will assess the circumstances and determine whether a proportional fee adjustment is appropriate, acting reasonably.
18. Emergencies and other unavoidable events
a. An 鈥淓mergency鈥 means a health emergency or other unavoidable event which is beyond the reasonable control of the College, which results in a situation in which the College determines in its sole discretion, based on advice from a medical professional, or a directive, bulletin, notice or other form of communication, order or legislation from a public health authority or other authority having jurisdiction, or other information or advice deemed relevant by the University (鈥淒irectives鈥), that a Resident, employees of the College or other persons or invitees, are or may be exposed to imminent danger from a dangerous condition or situation, damage to the Residences, disease, virus or other biological or physical agents that may be detrimental to human health, while in the Residences.
b. If an Emergency exists, the College may amend, supplement or otherwise enforce any rules or regulations in existence, may impose additional rules and regulations, and may impose restrictions to mitigate or minimize the effects of the Emergency.聽 Without limiting the generality of the foregoing:
i. during an Emergency, the College shall be entitled to restrict or limit access to Residences to employees of the College only, and/or to prohibit entry by a Resident, visitors or invitees for a reasonable period of time during such an event;
ii. notwithstanding that the College may have entered into an Occupancy Agreement with a Resident, the University shall have the right during an Emergency, to terminate such agreements prior to the commencement of the Occupancy Period, in order to comply with Directives or where the College determines that it will not be safe to operate Residences for a Fall and/or Winter semester, and the College shall have no liability to a Resident as a result of such termination;
iii. the College shall be entitled during an Emergency to close all or any part of the Residences if it determines that it is not safe to continue to operate the Residences or certain parts thereof, in which case a Resident shall vacate the Room they occupy in accordance with the reasonable requirements of the College;
iv. the College shall be entitled, during such time as there is an Emergency to require all Residents to comply with reasonable measures imposed in respect thereof by the College, including health screening, the use of hand washing and other sanitation products directly related to the management of the health threat, attendance at mandatory training sessions, and the use of additional protective clothing by all Residents such as protective barriers, gloves and masks; and
v. during an Emergency, the College shall also be entitled to specify specific modes of entry and exit from and to the Residences for Residents generally or Residents who may have a heightened risk of either exposure to a health threat or a heightened risk of transfer of unhealthy condition to other Residents, invitees or visitors in the Residences.
c. Where an Emergency or any other restrictive governmental laws or regulations, fire, damage, or other unavoidable event which is beyond the control of the College, results in the closure of the Residences during the Occupancy Period, the College, in its sole and absolute discretion shall determine what, if any, fees shall be refunded to the Resident, having regard to the length of the closure, the nature of the event causing the closure and such other factors as the College deems appropriate in the circumstances
19. It is understood by indicating agreement with these terms and conditions as part of the residence application process, the Resident is subject to all the terms and conditions herein.
